As a Creator, you should be extra mindful about your content. To protect yourself, you should produce original content without any third party materials. If you incorporate people or thrid party materials into content created for Capssion, it must have the proper rights and licences granted.

All the best practices listed below should not be taken as proper legal advice but they might help you create safe content. Please review them to avoid common copyright and third party rights pitfalls.

Social Networks’ Guidelines

Remember that all your content must be in compliance with Social Networks’ policies, including Instagram and Youtube. Take another look to remind yourself of what type of content isn’t allowed on the Instagram and Youtube platform!

Regulations around Disclosure

Anytime you create Content for a brand, you must disclose your connection with this brand, even if it’s only the provision of free products (and not only because of the law, also because it’s key to be honest with your community). It is important you adhere to your country’s regulation around disclosure. Please refer to the Legal section of the Help Center to have more information.

Permissions to shoot at a location

If you shoot in a third party location, you must have permission from the legal owner of the property. Remember, everything included at that location, including people, artwork, music playing over loudspeakers, etc. must also be fully cleared. Please research required permissions before shooting.

Keep in mind that not all public places are free to shoot in and that some iconic locations/buildings may be landmarked and require permission for inclusion in your video.

Please note that shooting in a third party location can often be more trouble than it’s worth since you have much less control over the environment.

Permissions for people appearing in your content

The general rule is that you need to have a written permission to use an image of a recognizable person for promotional purposes. And if you are not sure you need a release or not, keep in mind that the best option is always to get one. Minors appearing in your content must sign a release together with their parent or legal guardian.

If you don’t have a written permission for some people, you might be required to blur their faces.

Music must be licensed appropriately

No matter how incidental or how prominent, no matter how short or how long, any music or sound must be specifically licensed for that use.
